The early 1980s were a tumultuous time for Miami. Amid a public relations nightmare, Miami was ground central for cocaine importation and resulting street crime. Sadly, Miami also experienced widespread and systemic nursing home neglect. Miami’s elderly were dying in record numbers as greedy facility owners put their profits ahead of resident safety. Miami’s nursing homes were packed with patients and chronically understaffed. At that time, there was little government oversight and it was difficult to hold Miami nursing home’s accountable for neglect in lawsuits, given the laws on the books at that time. As expected, Miami nursing home abuse was rampant.
The Miami Grand Jury Investigation that Exposed Systemic Nursing Home Abuse
A 1980 Miami-Dade County Grand Jury investigation into Miami nursing home abuse, spearheaded by State Attorney Janet Reno, concluded that:
The Grand Jury investigation made waves which eventually made ripples in Tallahassee. Florida lawmakers took note of Miami’s nursing home abuse problem and the Florida legislature was shocked to learn that sixty percent of Miami nursing homes provided “unacceptable or consistently very poor care” for residents. After recognizing that the existing laws did not adequately protect vulnerable residents, the Florida Legislature passed the “Nursing Home Residents Rights Act” in response to the Grand Jury’s findings. The Nursing Home Residents Rights Act was passed to empower nursing home abuse victims statewide to sue negligent nursing homes for elder abuse and neglect.
